These Terms of Use ("Terms") govern your access to and use of the website located at ubcanl.org (the "Site"), operated by Ukrainian Business and Career Association of Newfoundland and Labrador Inc. ("UBCA-NL", "we", "our", or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately.
By accessing the Site, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are accessing the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You agree to use the Site only for lawful purposes and in a manner consistent with all applicable local, provincial, federal, and international laws and regulations. You agree not to:
All content on the Site — including but not limited to text, graphics, logos, images, photographs, audio clips, and software — is the property of UBCA-NL or its content suppliers and is protected by Canadian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and view the Site content for personal, non-commercial informational purposes only. No content may be reproduced, modified, distributed, transmitted, republished, displayed, or performed without UBCA-NL's prior written consent.
If you submit any information, messages, or content to UBCA-NL via contact forms, email, or other means, you grant UBCA-NL a non-exclusive, royalty-free, perpetual license to use, reproduce, and display such content in connection with our operations and programs. You represent that you have all necessary rights to the content you submit and that it does not infringe any third party's rights.
The Site may contain links to third-party websites or services, including but not limited to Stripe (payment processing), GoFundMe, Google, LinkedIn, Facebook, and Instagram. These links are provided for your convenience only. UBCA-NL does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party site or service. Your use of third-party sites is at your own risk and subject to their respective terms and policies.
Donations made through the Site are processed by Stripe, a third-party payment processor. UBCA-NL does not store your payment card information. All donations are voluntary. UBCA-NL is a nonprofit organization; donation receipts are issued in accordance with applicable Canadian nonprofit and tax regulations. The Site and all content, materials, and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
UBCA-NL does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site.
To the fullest extent permitted by applicable law, UBCA-NL, its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if UBCA-NL has been advised of the possibility of such damages.
UBCA-NL's total liability for any claim arising out of these Terms or your use of the Site shall not exceed CAD $100.00.
You agree to indemnify, defend, and hold harmless UBCA-NL and its directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador and the applicable federal laws of Canada, without regard to conflict of law principles. Any dispute arising out of these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in St. John's, Newfoundland and Labrador, Canada.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
UBCA-NL reserves the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, UBCA-NL, third parties, or the public.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and UBCA-NL with respect to your use of the Site and supersede all prior agreements and understandings.
